The Garrett Retirees Action Committee was formed to investigate our concerns with how our pension benefits were calculated. We found attorneys to investigate our claims and we hired an "Actuary" to analyze the formulas associated with our pension calculations. We filed a Claim Letter with Honeywell on July 26, 2002. Honeywell denied our claim and we filed a Class Action lawsuit against Honeywell on March 1, 2004. We are pleased to tell you that the Court approved a Partial Settlement in this case. The Partial Settlement does not resolve the 3 main issues in this case involving the Social Security and SBA Offsets. These claims continue to be litigated. The Partial Settlement does resolve the other issues of the case. The Partial Settlement provides for a recovery of $35 million with the potential to recover an additional $500 million if we are successful on the remaining main issues of the case. You must have returned a Claim Form postmarked no later than January 28, 2008 in order to receive any of the $35 million Partial Settlement benefits. We will post information about the case as it continues to be litigated, so please check back here for updates.
We are also asking all eligible retirees to consider joining the Garrett Retirees Action Committee in our efforts. Your membership is purely voluntary and does not in any way affect your rights as a class member in the lawsuit.
